Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Tasteit app or website. They are a binding agreement between you and [COMPANY LEGAL NAME] ("Tasteit", "we", "us", "our").

Important: Section 18 contains a binding individual arbitration agreement and a class action waiver. Recipes, nutrition information and scan results in Tasteit are created with artificial intelligence and can be wrong. Always check ingredients for allergens yourself. Tasteit does not provide medical or dietary advice (Section 5).

By creating an account or using the Service, you agree to these Terms, our Privacy Policy and our Community Guidelines. If you do not agree, do not use the Service.

3. Eligibility and age requirements

You must be at least 13 years old to use the Service. If you are between 13 and 17 years old, you may only use the Service with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Service. If we learn that a user is under 13, we will delete the account.

In some regions, Apple's App Store may ask for your age or for a parent's or guardian's consent before you can download the App or make purchases. We may receive an age range from the App Store and adjust the Service accordingly.

Tasteit uses artificial intelligence provided by Anthropic (Claude). Photos and text you share (for example recipe posts, fridge and receipt scans and challenge photos) are sent to Anthropic to create recipes and nutrition information, read scans, and check content for safety. See our Privacy Policy for details.

6. User Content

6.1 Your content stays yours

You keep ownership of your User Content. By submitting User Content, you confirm that you own it or have all rights needed to share it, and that it does not violate these Terms or anyone's rights. Only upload photos you took yourself or are allowed to use, and only show other people with their permission.

6.2 License you give us

You grant Tasteit a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt (for example resize, translate or format), display, publish and distribute your User Content in connection with operating, providing and promoting the Service. This includes showing public posts to other users, sending content to our service providers (such as Anthropic for AI processing) and creating AI-generated recipes and nutrition information from your posts. We do not use your User Content to train our own AI models, and we do not allow Anthropic to use it to train theirs.

This license ends when your User Content is deleted from the Service, except (a) where you shared it with others and they keep it as part of their use of the Service (for example messages you sent remain visible to the recipient), (b) for limited backup copies, and (c) where we must keep it to comply with the law.

6.3 Visibility

Posts, comments, your username, profile photo and bio are visible to other users and may be visible publicly. If your account is private, only approved followers can see your posts. Messages are visible to the people in the conversation, and in the limited cases described in Section 8 to our moderators.

Copyright: We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act. Send notices to our designated agent:

Your notice must include: your physical or electronic signature; identification of the copyrighted work; identification of the infringing material and where it is in the Service (for example the username and post); your contact information; a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law; and a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner's behalf. We may remove content and terminate the accounts of repeat infringers. If your content was removed by mistake, you may send a counter-notice as described in 17 U.S.C. § 512(g).

Intimate images shared without consent: If an intimate image of you was shared on Tasteit without your consent, report it in the App with the reason "Nude or intimate image of me" or email [LEGAL EMAIL] with a link to or description of the content, your contact information and a statement that it was shared without your consent. Reported content is hidden immediately in the App and removed within 48 hours of a valid request, together with known identical copies.

12. Deleting your account

You can delete your account in the App (Edit profile → Delete account). Your account is hidden right away and permanently deleted after 30 days. Until then you can restore it by logging in. After permanent deletion, your profile, posts, comments, likes, saved recipes, uploaded files and other personal data are deleted as described in our Privacy Policy. Messages you sent to others remain visible to them, shown as from "Tasteit user", and your voice messages can no longer be played. You can download a copy of your data in the App (Privacy → Download your data).

13. Third-party services

The Service relies on third-party services (for example Apple, Anthropic and our hosting providers) and may link to third-party content. We are not responsible for third-party services or content.

14. Intellectual property

The Service, including its design, software, logos and content we create (excluding User Content), is owned by Tasteit or its licensors and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for personal, non-commercial use and in line with these Terms and Apple's Usage Rules. You may not copy, modify, distribute, sell or reverse engineer any part of the Service. If you send us feedback, we may use it without obligation to you.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time if you violate these Terms, if required by law, or to protect users or the Service. Sections that by their nature should survive termination (such as 6.2 for shared content, 5, 16–19) survive.

16. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU.

17. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TASTEIT AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

You agree to indemnify and hold Tasteit harmless from claims arising from your User Content or your violation of these Terms or of anyone's rights.

18. Arbitration and class action waiver

Please read this section carefully. Except for claims that qualify for small claims court and claims for injunctive relief regarding intellectual property, you and Tasteit agree to resolve any dispute relating to the Service or these Terms through final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Before starting arbitration, you agree to first contact us at [LEGAL EMAIL] and try to resolve the dispute informally for 30 days. You and Tasteit waive the right to a jury trial and to participate in a class action, class arbitration or representative action. You may opt out of this arbitration agreement by emailing us within 30 days after first accepting these Terms.

19. Governing law

These Terms are governed by the laws of the State of [STATE], without regard to its conflict of law rules, and applicable U.S. federal law. Subject to Section 18, courts located in [STATE] have exclusive jurisdiction.

20. Apple

These Terms are between you and Tasteit, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the App (including product liability, legal compliance or intellectual property claims). If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.

21. Changes, severability and contact

We may update these Terms. If changes are material, we will notify you in the App or by other reasonable means before they take effect. Continued use after changes take effect means you accept them. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver.
